BALMOHK Terms & Conditions 

1. Introduction & Scope 

These Terms & Conditions explain the rules for using our website www.balmohk.com  and buying from us. 

 The Platform is owned and operated by BALMOHK FASHION S.L.U., a Spanish company with NIF B75655159, registered at Calle Méndez Álvaro 55‑61, 28045 Madrid, Spain. 

By using our Platform, you agree to these Terms & Conditions and to our Privacy Policy and Cookies Policy. If you do not agree, you should not use the Platform or place an order. 

We may update these Terms from time to time. The version in force at the time you place your order will apply to your purchase. 

 

2. Website Use 

  • All brand names, trademarks, and content on our Platform belong to BALMOHK or its partners and are protected by law. 

  • You may only use the content for personal, non‑commercial purposes and must keep all copyright notices intact. 

  • You must not copy, distribute, or use any part of our website without our permission. 

  • You must provide accurate contact details when requested. We may use these details to contact you if necessary. 

  • You must not place false or fraudulent orders. If we suspect fraud, we may cancel your order, deactivate your account, and inform the relevant authorities. 

  • You must be at least 18 years old and legally capable of entering a binding contract to place an order. 

 

3. Sale Terms 

3.1 Conclusion of Contract 

When you place an order through the Platform, you are making an offer to buy our products under these Terms. 

 The contract is only formed when we send you an Order Confirmation email followed by a Shipping Confirmation email. 

 If a product is not available or your order is not accepted, we will refund any money you have paid. 

3.2 Order Process & Corrections 

Before confirming payment, you can review and change your order details in your shopping cart. 

 If you spot an error after payment, contact support@balmohk.com immediately so we can try to correct it. 

3.3 Service Availability 

We currently deliver only within Spain. Orders from other countries can be placed, but the delivery address must be in Spain. 

3.4 Product Availability 

All orders depend on product availability. If an item is out of stock or cannot be supplied, we will refund you in full. 

3.5 Pricing & Taxes 

Prices are shown in euros (€) and include VAT at the current rate. Delivery costs are extra and shown before checkout. 

 For orders to the Canary Islands, Ceuta, and Melilla, local taxes and customs duties may apply. 

3.6 Payment 

We accept Visa, Mastercard, PayPal, BALMOHK gift cards, and fashioncheque voucher cards. 

 Your payment details are encrypted for security. If your payment is not authorised, we cannot process your order. 

 By clicking Authorise payment, you confirm you are the cardholder or have permission to use the card. 

3.7 Delivery 

We aim to deliver orders within the time stated on your Shipping Confirmation and always within 30 days. 

 If delivery is delayed by something beyond our control, we will contact you and offer options, including cancelling for a full refund. 

 Delivery is complete when you, or someone you nominate, signs for the package at the delivery address. 

3.8 Ownership & Risk 

You own the products once we receive full payment. Risk passes to you when the products are delivered. 

 

4. Returns, Refunds & Exchanges 

You have 30 days from the shipping confirmation date to return your items. 

4.1 Condition of Returns 

Items must be unused, in perfect condition, and returned with original packaging, labels, and any accessories. 

 You cannot return: 

  • Customised or personalised products. 

  • Sealed items that have been opened (e.g. lingerie, swimwear, earrings, socks, cosmetics, perfumes, candles). 

4.2 How to Return 

You can choose one of these options: 

a) In a BALMOHK store – Free 

 Bring the item(s) with your e‑ticket or invoice. 

b) Drop‑Off Point – Small fee deducted from refund 

 Request a return from your account, choose a drop‑off point, print or show the QR code, and drop the parcel off. 

c) By post or courier – At your cost 

 Send to:

We recommend tracked shipping. BALMOHK is not responsible for lost or damaged returns. 

d) From Canary Islands, Ceuta, Melilla – At your cost 

 Mark the package as “RETURN” and attach the purchase invoice outside to avoid customs charges. 

4.3 Refunds 

We’ll process your refund within 14 days of receiving your return, using the same payment method you used. 

 We may delay the refund until we receive the goods or proof you have sent them. 

4.4 Exchanges 

We don’t offer direct exchanges. Return the unwanted item and place a new order. 

 

5. Faulty Products 

If you believe a product is faulty, damaged, or develops a defect, please contact support@balmohk.com as soon as possible. 

 You will need to provide proof of purchase (such as your e‑ticket or invoice). 

 We will inspect the item and, if confirmed faulty, you will receive a full refund including any delivery charges, using your original payment method. 

 This does not affect your legal rights. 

 

6. Warranty 

All products bought on our Platform come with a 3‑year legal warranty for non‑conformity under Spanish law. 

 If your product does not meet the agreed‑upon quality standards within this period, contact us for assistance. 

 

7. Liability 

Our total liability for any loss or damage relating to your order will not exceed the total price you paid for that order. 

 We are not responsible for indirect losses such as loss of profit, loss of opportunity, or other incidental damages. 

 We are not liable for delays or failures caused by events beyond our reasonable control. 

 

8. Cybersecurity & Misuse of the Platform 

You must not: 

  • Intentionally introduce viruses, malware, or harmful code to the Platform. 

  • Attempt unauthorised access to our website, servers, or databases. 

We take reasonable steps to keep the Platform secure, but we are not liable for damage caused by cyber‑attacks beyond our control. 

 We may block access and report misuse to the authorities. 

 

9. Links to Third‑Party Websites 

Our Platform may link to websites we do not control. 

 We are not responsible for the content, security, or privacy practices of those third‑party sites. 

 Accessing them is at your own risk. 

 

10. Communications 

By using our Platform, you agree to receive most communications from us electronically (via email or through notices on the Platform). 

 For contractual purposes, you agree that these electronic communications meet any legal requirement that such communications be in writing. 

 This does not affect your statutory rights. 

 

11. Notifications

  • Immediately if posted on our website. 

  • 24 hours after sending by email.

12. Transfer of Rights 

You may not transfer your rights or obligations under these Terms without our written consent. 

 We may transfer our rights and obligations to another organisation without affecting your legal rights. 

 

13. Force Majeure 

We are not responsible for delays or failure to perform our obligations if caused by events beyond our reasonable control (“force majeure”), such as natural disasters, strikes, civil unrest, war, or government actions. 

 

14. Waiver 

If we do not insist on you fulfilling any of your obligations under these Terms, or if we delay enforcing our rights, that does not mean we have waived those rights. 

 Any waiver will be in writing and will not mean we waive any subsequent breach. 

 

15. Severability 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 

 

16. Entire Agreement 

These Terms, together with our Privacy Policy and Cookies Policy, make up the entire agreement between you and BALMOHK regarding the use of our Platform and the purchase of our products. 

 They replace any previous agreements, understandings, or discussions. 

 

17. Changes to Terms 

We may update these Terms from time to time. 

 Changes will not apply retroactively unless required by law. 

 The version in force when you place your order will apply to that order. 

 

18. Governing Law & Jurisdiction 

These Terms are governed by Spanish law. 

 Any disputes will be handled by the competent courts in Spain, without affecting your legal rights as a consumer.
